County commissioners vote to clear up hazy cannabis use policy

Bernalillo County commissioners in New Mexico are considering changes to the county’s drug and alcohol policy that would allow most employees to use cannabis off-duty without facing random or pre-employment testing.

On Tuesday, commissioners approved the proposed policy update in a 4-0 vote, with a final decision expected in December.


The proposed changes, sponsored by Commissioner Eric Olivas, align with New Mexico’s legalization of recreational cannabis in 2022. Olivas emphasized that the county will still maintain a “drug- and alcohol-free workplace,” clarifying that no one should come to work under the influence of any substance. The policy aims to resolve inconsistencies regarding cannabis use across various county departments, as some positions, like firefighters, remain unsure about their rights under the current policy.


However, the changes won’t apply to all employees. Those required to carry a firearm, hold a commercial driver’s license, or work in federally funded roles will still be subject to random and pre-employment cannabis testing due to federal regulations.


Representatives from the firefighter union Local 244, Vice President Theodore Ygbuhay and President Miguel Tittmann, voiced support for the policy change, advocating for employees’ rights to use cannabis as a form of medicine on their days off. Tittmann highlighted the challenge of advancing such legislation, even in a state like New Mexico where cannabis is legal.


Commissioner Olivas expressed bipartisan optimism for the resolution, noting that cannabis reform has gained traction across the political spectrum. Republican Commissioner Walt Benson also voiced support, noting that cannabis may serve as a healthier alternative for some first responders who have turned to alcohol to manage trauma and stress-related challenges. Benson’s support underscores a growing acknowledgment of cannabis as a potential tool for those coping with PTSD, trauma, and other mental health struggles.
