Federal Appeals Court Schedules Oral Argument In Case Seeking To Overturn U.S. Marijuana Prohibition

A federal appellate court has set oral arguments for December 5 in a case challenging the U.S. government's prohibition on marijuana.

The lawsuit, brought by cannabis businesses including Verano Holdings, contends that the federal ban is unconstitutional and argues that Congress no longer aims to eradicate marijuana.


The companies also highlight state-regulated cannabis markets and federal actions like rescheduling efforts.


A district court previously dismissed the case, but the appeal will now be heard by the First Circuit in Boston.
