The lawsuit, brought by cannabis businesses including Verano Holdings, contends that the federal ban is unconstitutional and argues that Congress no longer aims to eradicate marijuana.
The companies also highlight state-regulated cannabis markets and federal actions like rescheduling efforts.
A district court previously dismissed the case, but the appeal will now be heard by the First Circuit in Boston.
