A former Nebraska state senator has filed a lawsuit aiming to block two medical marijuana initiatives from appearing on the November 5 ballot. John Kuehn, a veterinarian and vocal opponent of marijuana legalization, claims the petitions are invalid due to signature collection issues and other procedural problems.

Kuehn argues that Secretary of State Bob Evnen should not certify the petitions, which gathered over 114,000 signatures to legalize and regulate medical cannabis. He cites seven main reasons, including fraudulent signatures and violations of state constitutional rules.
The two measures, backed by Nebraskans for Medical Marijuana, would legalize the use of medical cannabis and create a state commission to regulate it. Campaign leaders, including State Senator Anna Wishart, remain confident the petitions meet all legal requirements.
The lawsuit comes just days before the September 20 deadline for certifying ballots, making it likely that the case will head to the Nebraska Supreme Court. This is the third attempt by medical marijuana advocates to put the issue to a vote, following past setbacks in 2020 and 2022.
The Attorney General’s office has announced a news conference to discuss the case, which could have major implications for Nebraska’s cannabis laws.
