Louisville firefighters file lawsuit against Metro government for right to use medical marijuana

LOUISVILLE, Ky. (WDRB) — Louisville firefighters want to be able to use medical marijuana.

A lawsuit filed this week against Louisville Metro states, according to their Collective Bargaining Agreement, firefighters wouldn't be disciplined for using medical marijuana as long as they didn't come to work while using the drug.

Also according to the lawsuit, the current contract states medical marijuana would be treated like other prescription drugs.

However, the lawsuit states Chief Brian O'Neill sent an email to staff saying the department would continue to prohibit all use of marijuana by employees.

In an email to the chief, the Louisville Professional Firefighters Association president said due to the physically and mentally demanding conditions firefighters have to work under, there would be benefits to using marijuana.

Therefore, the union president said the contract protects his members who may choose to seek it as medical treatment.

The lawsuit asks that union members be allowed to use the drug.
